Data protection legislation

Data protection legislation gives legal rights to individuals (data subjects) who have personal data held about them. 

The legislation regulates the holding and processing of personal information that:

  • relates to living individuals
  • is held on computer, or in some cases paper

If you have information stored about you, the legislation gives you certain rights. These rights apply to everyone, whether they're an employee, elected member, or a member of the public.

We're committed to ensuring compliance with Data Protection legislation. We recognise the importance of personal data to our business, and the importance of respecting the privacy rights of individuals.

Individual rights under General Data Protection Regulations (GDPR)

The right of access, commonly referred to as subject access, gives individuals the right to obtain a copy of their personal data as well as other supplementary information. These can be made in writing, or verbally.  We're required to respond to subject access requests within one calendar month. A fee can't be charged in most circumstances, but not all. Excessive requests may incur a charge.

Access to personal information

You can make requests for access to your own personal information. Please complete the form below, and return it to the Data Protection Officer.

You’ll be asked to provide proof of identity. This can be a copy of your passport, driving licence, birth certificate or some other official document bearing your signature.

In some cases, we’ll also require a recent photograph of you for elimination purposes.

DPA Schedule 2 Request

Schedule 2 of the Data Protection Act 2018 permits King’s Lynn and West Norfolk Borough Council (the council) to disclose personal information to a third-party organisation that has a crime prevention, law enforcement or tax collection function, if the information is needed to prevent or detect a crime, to apprehend or prosecute an offender or to assess or collect a tax or duty.

Please be aware that we may ask for ID or proof of authorisation before processing your request. Making a request does not guarantee release of information and in some situations the decision may be taken not to release the information.
